Signs Decals No More...

Hey Guys & Gals,
Some already know this, but for those that have not heard, 'tis true....the website is down and I am no longer taking orders.

First, there was a slight copyright issue I had to deal with, with American Honda Motor Company. It didn't cost me too much, but it could have, and it made me pretty gun shy about all the other stuff on the site. I know Tapeworks and AllOutGraphics got hit as well, and I am assuming many others. Easy to get complacent about that when "everyone is doing it" all over the internet...I've recently heard that Suzuki started going after all sorts of people for decals and also engraved/milled parts with logos.

Then in February I took a part-time "real" job at Lowes to compensate for up and down trends in my business (and even when I was trending up, it was really only just enough), combined with an adjustable rate mortgage that was, well, adjusting. Needless to say we were in a pretty tight spot, and the job was the "responsible" thing to do for me, and my wife and daughter. June comes and they offer me a pretty decent full-time gig as LNS (Live Nursery Specialist), which manages all the plants and live goods we sell at Lowes. Kind of right up my alley, really.
So the decision to shut things down came with that new postition, because running my business while working full-time really sucks. It's how I got started, and that was well before it grew into what it became. I can't imagine trying to keep the same volume while working full time. So, it was a pretty cool chapter in my life, and it allowed my to basically stay home with my daughter for the first 3 years of her life.

So basically, that's the story.

Anyone interested in buying a vinyl plotter with software and some inventory? lol...

Don't really know for sure....I know that the day I got my letter in the mail, I immediately went to the TapeWorks and AllOutGraphics sites, and all of their HONDA pages were removed, with no explanation. After talking with the nice lady in the Law Department (Yikes!) I made a comment to her that I guess I wasn't the only one, and she laughed and said definitely not.

I'm not sure why it took so long...people have been making this stuff and selling it online forever now...I mean, how long was Tapeworks around? They were probably one of the first....

I'm sure if I had never set up online shopping it never would have happened, but since the items were advertised on my site, with pics and everything, it wasn't that hard to find. Of course, neither was everyone else's stuff.

I could have gotten permission from them to put the stuff back on my site, and continue to sell it "legally", but that would have cost me 15% of gross sales of everything HONDA related. As it was, I had to pay them 15% of my gorss sales of all Honda stuff I already sold. That was just to keep it from going into further litigation. I'm not really sure what they could have done, but I did not want to find out!

Yeah definitely. I wouldn't think chasing sticker guys and gals would yield that much money, but you never know .. I'm sure when all is said and done, it must be a significant chunk of change.

did they even offer a 'legal' alternative to shutting down? I understand they want their cut and all...

I understand not being able to sell their little 'wing' logo, but can't you get away with sending me "AH ON D"

i mean, you can't keep me from rearranging the letters...

Lol....that's pretty good.

They didn't ever say anything about shutting down...all they wanted me to do was pay them 15% of the gross revenue of everything I sold that was Honda related, and if I continued to pay them 15%, I could keep selling the stuff, basically.

Shutting down was my choice, the issue with Honda was only a very small portion of that choice. The volume just wasn't enough or consistent enough for it to be my sole income...my mortgage is more imprtant than being able to stay at home and work in my 'jammies. :D

Maybe down the road I'll try something else...who knows. Right now I'm kinda' diggin' the way things are working out.

its a trademark issue as well. if companies don't protect the use of their mark, they can lose the rights to it all together.
